RESOLUTION 10-2114 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXTENSION (SPR 09-15) OF A SITE PLAN APPROVAL (SPR 07-19) FOR THE <br />GENEVA SCHOOL DEVELOPMENT LOCATED WITHIN THE LEGACY PARK <br />PLANNED DEVELOPMENT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Casselberry provided site plan (SPR 07-19) <br />approval for the Geneva School development located within the Legacy Park Planned Development on <br />February 23, 2009; and <br />WHEREAS, the site plan approval is due to expire on February 23, 2010; and <br />WHEREAS, the City's Unified Land Development Regulations provide an opportunity for a <br />one- year site plan extension per Section 4-18.5; and <br />WHEREAS, the applicant has requested a site plan extension due to the current economic <br />conditions. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission of the City of Casselberry hereby approves the one-year <br />extension (SPR 09-15) of site plan approval for the Geneva School development site plan located <br />within the Legacy Park Planned Development. Such extension shall expire on February 23, 2011. <br />This action is based on the original conditions of approval for SPR 07-19 provided on February 23, <br />2009. <br />SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION 3. Severability, If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br />SECTION 4. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />PASSED AND ADOPTED this day of Fe—bP c4 , AD, 2010. <br />ATTEST: <br />Donna G.
