RESOLUTION 10-2114 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXTENSION (SPR 09-15) OF A SITE PLAN APPROVAL (SPR 07-19) FOR THE GENEVA SCHOOL DEVELOPMENT LOCATED WITHIN THE LEGACY PARK PLANNED DEVELOPMENT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Casselberry provided site plan (SPR 07-19) approval for the Geneva School development located within the Legacy Park Planned Development on February 23, 2009; and WHEREAS, the site plan approval is due to expire on February 23, 2010; and WHEREAS, the City's Unified Land Development Regulations provide an opportunity for a one- year site plan extension per Section 4-18.5; and WHEREAS, the applicant has requested a site plan extension due to the current economic conditions. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Casselberry hereby approves the one-year extension (SPR 09-15) of site plan approval for the Geneva School development site plan located within the Legacy Park Planned Development. Such extension shall expire on February 23, 2011. This action is based on the original conditions of approval for SPR 07-19 provided on February 23, 2009. SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION 3. Severability, If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION 4. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this day of Fe—bP c4 , AD, 2010. ATTEST: Donna G.
