RESOLUTION 10-2115 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND CPH <br />ENGINEERS, INC. (CPH) FOR ENGINEERING DESIGN AND CONSTRUCTION <br />ADMINISTRATION SERVICES FOR THE TANGLEWOOD WATER MAIN REPLACEMENT <br />PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the asbestos cement water mains in the Tanglewood subdivision are over 53 years old, have <br />surpassed its life expectancy, and are deteriorating rapidly; and <br />WHEREAS, Tanglewood is located in unincorporated Seminole County where the only approved water main <br />replacement method is open cut construction; and <br />WHEREAS, in order to perform said methodology for water main replacement, professional engineering <br />services is required; and <br />WHEREAS, the City has a continuing services contract with CPH for engineering design services; and <br />WHEREAS, CPH has submitted Supplement No. 30 in an amount not to exceed $145,397.90 ($82,426.40 <br />for design, permitting, and bidding and $62,971.50 for construction administration); and <br />WHEREAS, City staff have reviewed Supplement No. 30 submitted by CPH and found it to be adequate to <br />meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves Supplement No. 30 with <br />CPH, attached as Attachment "A", and authorizes the Mayor to execute said document(s) on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this <br />Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and <br />adoption. <br />PASSED and ADOPTED this day of rtAar AD 2010. <br />ATTEST: <br />e <br />Donna G.
