RESOLUTION 10-2107 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND KILLEBREW, INC. FOR CONSTRUCTION OF THE CASSELBERRY WATER QUALITY IMPROVEMENT PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the American Recovery and Reinvestment Act (ARRA), which authorized the release of grant and loan funding for economic stimulus projects, was enacted on February 17, 2009; and WHEREAS, the Florida Department of Environmental Protection (FDEP) has received a portion of ARRA funds for construction of water quality improvement projects and has permitted local government agencies and municipalities to receive a share of these funds for qualifying water quality improvement projects; and the State Revolving Fund (SRF) priority list designates Project Number DW Project No. 590300 as eligible for available funding; and WHEREAS, at its September 28, 2009 meeting, the Casselberry City Commission approved the agreement between the City of Casselberry and FDEP for construction of the Casselberry Water Quality Improvement Projects; and WHEREAS, the City of Casselberry advertised for bids in the Orlando Sentinel on Sunday November 1, 8, 15, 22 and 29, 2009 for the Casselberry Water Quality Improvement Projects; and WHEREAS, on December 4, 2009, the City received (2) sealed bids; and WHEREAS, of the bids received and evaluated, Killebrew, Inc., provided the lowest, qualified bid in the amount of $2,479,292.75; and WHEREAS, the City's ARRA/FDEP grant/loan totals $3M and will be funded in part by a $2.55M grant and a $450K loan; and WHEREAS, City staff have reviewed the bid proposal from Killebrew, Inc. and found it to be the lowest responsive, responsible, and adequate bid proposal to meet the project requirements of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement with Killebrew, Inc., attached as Exhibit "A", and authorizes the Mayor to execute said document(s) on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawfiil, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
