<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
<br />CASSELBERRY, FLORIDA, APPROVING A SIDEWALK, LANDSCAPE,
<br />AND UTILITY EASEMENT AGREEMENT WITH CASTO
<br />CASSELBERRY LLC AND GENDER THIRTY-THREE, LLC FOR THE
<br />LAKE CONCORD PARK COMMERCIAL SUBDIVISION; PROVIDING
<br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE.
<br />WHEREAS, the subject property is Lot 4 of the Lake Concord Park, Unit IA, Replat, as
<br />recorded in the Seminole County Public Record, Book 79, Pages 90-93; and
<br />WHEREAS, the replat of this property requires that a Sidewalk, Landscape, and Utility
<br />Easement Agreement with the property owners be made with the City of Casselberry; and
<br />WHEREAS, Casto Casselberry LLC and Gender Thirty -Three, LLC, the owners of the
<br />Lake Concord Park Commercial Subdivision property, have executed a sidewalk, landscape and
<br />utility agreement in favor of the City; and
<br />WHEREAS, this agreement conveys a non-exclusive public easement over certain portions
<br />of the property to the City for the construction, installation, operation, maintenance, replacement,
<br />and repair of sidewalk, landscaping, irrigation, and utilities; and
<br />WHEREAS, City staff has reviewed the Sidewalk, Landscape, and Utility Easement
<br />Agreement and have found it favorable to meet the needs of the City.
<br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
<br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
<br />SECTION I. The City Commission of the City of Casselberry hereby approves the
<br />Sidewalk , Landscape, and Utility Easement Agreement with Casto Casselberry LLC and Gender
<br />Thirty -Three, LLC for the Lake Concord Park Commercial Subdivision, attached herewith, and
<br />authorizes the Mayor to execute said document on behalf of the City.
<br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the
<br />provisions of this Resolution are hereby repealed.
<br />SECTION III. Severability. If any Section or portion of a Section of this Resolution
<br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the
<br />validity, force, or effect of any other Section or part of this Resolution.
<br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon
<br />its passage and adoption.
