RESOLUTION 20-3216 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING A UTILITY EASEMENT AGREEMENT WITH CASTO CASSELBERRY LLC FOR THE LAKE CONCORD PARK COMMERCIAL SUBDIVISION; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the subject property is Lot 4 of the Lake Concord Park, Unit IA, Replat, as recorded in the Seminole County Public Record, Book 79, Pages 90-93; and WHEREAS, the replat of this property requires that a Utility Easement Agreement with the property owner be made with the City of Casselberry; and WHEREAS, Casto Casselberry LLC, the owner of part of the Lake Concord Park Commercial Subdivision property, has executed a utility easement agreement in favor of the City; and WHEREAS, this agreement conveys a non-exclusive public easement over certain portions of the property to the City for the construction, installation, operation, maintenance, replacement, and repair of utilities; and WHEREAS, City staff has reviewed the Utility Easement Agreement and have found it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Utility Easement Agreement with Casto Casselberry LLC for the Lake Concord Park Commercial Subdivision, attached herewith, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this day oft%; , AD 2020.
