WHEREAS, on June 13, 2022, the City Commission adopted Resolution 22-3308 <br />(the "Preliminary Rate Resolution"); and <br />WHEREAS, pursuant to the provision of the Ordinance, the City Commission is <br />required to confirm or repeal the Preliminary Rate Resolution with such amendments as <br />the City Commission deems appropriate after hearing comments and receiving <br />objections from all interested parties; and <br />WHEREAS, the Assessment Roll has heretofore been made available for <br />inspection by the public as required by the Ordinance; and <br />WHEREAS, as required by the Ordinance, notice of a public hearing has been <br />published and mailed to each property owner proposed to be assessed notifying such <br />property owner of the opportunity to be heard concerning the assessments; the proof of <br />publication and an affidavit of mailing are attached hereto as Appendices A and B <br />respectively; and <br />WHEREAS, a public hearing has been duly held on August 8, 2022 and <br />comments and objections of all interested persons have been heard and considered as <br />required by the terms of the Ordinance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. AUTHORITY. This Resolution of the City of Casselberry, <br />Florida (the "City") is adopted pursuant to City Ordinance No. 09-1301 (the <br />"Assessment Ordinance"), City Resolution No. 22-3308 (the "Preliminary Rate <br />Resolution"), Sections 166.021, 166.041 and 197.3632, Florida Statutes, and other <br />applicable provisions of law. <br />SECTION 2. DEFINITIONS. This Resolution is the Final Assessment <br />Resolution. Capitalized terms not otherwise defined in this Resolution shall have the <br />meanings defined in the Assessment Ordinance and the Preliminary Rate Resolution. <br />SECTION 3. FINDINGS. It is hereby ascertained, determined and <br />declared that.- <br />(A) <br />hat: <br />(A) The findings provided in Section 1.04 of the Preliminary Rate Resolution are <br />hereby ratified, confirmed, and incorporated as if set forth fully herein. <br />(B) On June 13, 2022, the City Commission adopted the Preliminary Rate <br />Resolution which described the Street Lighting Services, provided for the funding <br />thereof through Street Lighting Assessments and the method of assessing the cost of <br />such services against the real property located within the City that will be specifically <br />benefited thereby, established a public hearing to consider imposition of the <br />E <br />
