RESOLUTION 22-3318 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />CITY MANAGER TO REQUEST IMMEDIATE WITHDRAWAL FROM <br />AGREEMENT A1010 WITH THE FLORIDA DEPARTMENT OF <br />ENVIRONMENTAL PROTECTION FOR A FLORIDA RECREATION <br />DEVELOPMENT ASSISTANCE PROGRAM GRANT FOR "WHEEL <br />PARK - CASSELBERRY — PHASE 2"; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry's 2017 Parks, Recreation, Pathways, and Open Spaces <br />Master Plan included a recommendation to develop a new park in the northern part of the City; and <br />WHEREAS, the City Commission of the City of Casselberry has committed to preserve the <br />City -owned "Northeast Industrial Park" properties for future park space; and <br />WHEREAS, the City of Casselberry has planned for various park improvements to the <br />western side of the "Northeast Industrial Park", including bike and skate -oriented elements, under <br />the working name "Wheel Park — Casselberry — Phase 2", a.k.a., "Wheel Park" — Phase 2; and <br />WHEREAS, on October 15, 2019, the City of Casselberry applied to the Florida <br />Department of Environmental Protection (FDEP) for $200,000 in Florida Recreation Development <br />Assistance Program (FRDAP) funding with a $200,000 local match commitment, for a total of <br />$400,000 to construct "Wheel Park — Casselberry — Phase 2"; and <br />WHEREAS, FDEP ranked the City of Casselberry's application #10 in the State of Florida <br />and awarded the requested grant funding for the City's project; and <br />WHEREAS, FDEP provided the City of Casselberry Grant Agreement A1010 to execute <br />the project under the terms of the grant, which was approved by the City Commission via <br />Resolution 20-3194 on September 14, 2020; and <br />WHEREAS, while the City has diligently worked to finalize design and prepare for <br />construction of this project, City staff has determined that the proposed project cannot be <br />responsibly constructed by the Agreement's project completion deadline of April 30, 2022; and <br />WHEREAS, FDEP has indicated the project is ineligible for time extensions; and <br />WHEREAS, the project site will remain ineligible to apply for future FRDAP grants as <br />long as there is an active FRDAP Grant Agreement; and <br />WHEREAS, City staff has determined it is in the City's best interest to immediately <br />withdraw from the current Grant Agreement A1010 so that the site becomes eligible for future <br />FRDAP grant applications. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
