ORDINANCE 22-1567 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />PROVIDING FOR A CHANGE OF THE FUTURE LAND USE <br />DESIGNATION FROM LOW DENSITY RESIDENTIAL TO PUBLIC <br />SERVICE FOR APPROXIMATELY 0.91 ACRES LOCATED AT 176 <br />SOUTH WINTER PARK DRIVE, AS DESCRIBED IN SECTION I OF THIS <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />AN EFFECTIVE DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") is <br />within the corporate boundaries of the City of Casselberry; and <br />WHEREAS, the Property consists of Parcel 16-21-30-502-0000-0140, and is owned by <br />the City of Casselberry; and <br />WHEREAS, the Property has a City of Casselberry Future Land Use Map (FLUM) <br />designation of Low Density Residential; and <br />WHEREAS, the City desires to construct a nutrient reduction facility on the Property to <br />advance stewardship of the natural environmental; and <br />WHEREAS, the existing FLUM designation is not consistent with the proposed <br />development; and <br />WHEREAS, to allow for appropriate future development, the Property should be <br />developed consistent with the Public Service FLUM designation; and <br />WHEREAS, the Property is less than 50 acres, requiring a small-scale amendment to the <br />Comprehensive Plan; and <br />WHEREAS, Section 163.3187 of the Florida Statutes establishes a process for adoption <br />of small-scale comprehensive plan amendments including amendments to the FLUM; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this FLUM amendment on May 11, 2022; and <br />WHEREAS, a public hearing considering amendment of the FLUM designation for the <br />property hereinafter described, has been duly held by the City Commission of the City of <br />Casselberry, Florida, and at such hearing, interested parties and citizens were heard; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, considered the Comprehensive Plan amendment and determined that the Future Land Use <br />designation of the Property, consisting of approximately 0.91 acres, shall be established as Public <br />Service, as defined in Future Land Use Element Objective FLU 1, as amended and supplemented, <br />of the Comprehensive Plan of the City of Casselberry, Florida; and <br />WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the <br />Florida Statutes. <br />
