RESOLUTION 21-3276 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING A UTILITY AGREEMENT FOR WATER SERVICE WITH TIMOTHY D. EGGERS FOR 2806 LAKE HOWELL LANE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City currently provides potable water to unincorporated Seminole County residents east along Lake Howell Lane up to Lake Howell Trail; and WHEREAS, properties past this point obtain their drinking water through private ground water wells; and WHEREAS, Timothy D. Eggers, property owner of 2806 Lake Howell Lane, relies on well water but has expressed his intentions to connect to the City's potable water system; and WHEREAS, in order to facilitate this request, the City requires the execution of a Utility Agreement, connection to the City's water main from the subject property, and payment of associated fees; and WHEREAS, City staff has reviewed the Utility Agreement for Water Service and have found it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Utility Agreement for Water Services with Timothy D. Eggers for 2806 Lake Howell Lane, attached herewith, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
