RESOLUTION 22- 3292 <br />A RESOLUTION OF THE CITY COMMISSION OF CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING THE APPROVAL AND <br />ACCEPTANCE OF A MEMORANDUM OF UNDERSTANDING WITH <br />SEMINOLE COUNTY, SEMINOLE COUNTY SCHOOL BOARD, AND THE <br />CITIES OF ALTAMONTE SPRINGS, CASSELBERRY, LAKE MARY, <br />LONGWOOD, OVIEDO, SANFORD AND WINTER SPRINGS FOR THE <br />EMERGENCY USE OF MEETING FACILITIES; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, elected and appointed commissions and boards must continue to meet, set <br />policy and operate after a disaster, during times of emergency; or in the event their regularly scheduled <br />meeting location is unavailable; and <br />WHEREAS, some parties may not be affected by an individual disaster while other parties <br />may sustain damage and require assistance from a neighboring party; and <br />WHEREAS, in 2014, the City of Casselberry approved Resolution 14-2611 which authorized <br />a Memorandum of Understanding (MOU) with Seminole County, the Seminole County School Board <br />and the Cities of Altamonte Springs, Casselberry, Lake Mary, Longwood, Oviedo, Sanford and <br />Winter Springs to offer the use of their facilities and information technology infrastructure to conduct <br />governmental meetings to one or more parties whose facilities have become unusable due to a disaster <br />or emergency; and <br />WHEREAS, as this MOU expired in 2019, the parties wish to continue this cooperative effort <br />with a term of ten years. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission of the City of Casselberry hereby approves and accepts <br />the Memorandum of Understanding with Seminole County, the Seminole County School Board and <br />the Cities of Altamonte Springs, Casselberry, Lake Mary, Longwood, Oviedo, Sanford, and Winter <br />Springs (attached as Exhibit A) and authorizes the Mayor to execute said document on behalf of the <br />City. <br />SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION 3. Severability. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br />
