RESOLUTION 14-2678 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />ENTER INTO A PLANNED UNIT DEVELOPMENT AGREEMENT WITH <br />THE ALLEGRO AT CASSELBERRY, L.L.C.; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, The Allegro at Casselberry, LLC (Allegro) wishes to construct a nursing <br />home (assisted living facility) consisting of 85 dwelling units and 84 suites (combined 229 <br />beds) on the property located northeasterly of the intersection of Howell Branch Road and <br />Lake Ann Lane; and <br />WHEREAS, the City and Allegro desire to recognize a mutual obligation for the <br />planning, development, and use of the property; and <br />WHEREAS, a Planned Unit Development Agreement provides in detail the mutual <br />obligations voluntarily entered into by each party; and <br />WHEREAS, the City Commission agrees that this Planned Unit Development <br />Agreement is a sound development plan that will accomplish the goals of the City of <br />Casselberry. <br />NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of <br />Casselberry, Florida: <br />SECTION I. The City Commission hereby accepts the terms and conditions as <br />presented in the "Planned Unit Development Agreement," and authorizes the Mayor to execute <br />said document, attached as "Attachment A" and made a part hereof. <br />SECTION II. CONFLICTS. All Resolutions or parts of Resolutions in conflict with <br />any of the provisions of this Resolution are hereby repealed. <br />SECTION III. SEVERABILITY. If any Section or portion of a Section of this <br />Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. EFFECTIVE DATE.
