WHEREAS, the City Commission finds that it is in the best interests of <br />the citizens of Casselberry, Florida, to amend the Code of Ordinances as <br />specified hereinafter. <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That Ordinance 717, Section VI, Definitions, Subsection B, <br />Adult Bookstore, is hereby amended as follows: <br />Section VI - Definitions. <br />B. Adult Bookstore. An establishment which sells or <br />rents adult material, unless the adult material is <br />accessible only by employees and the gross income from <br />the sale or rental of adult material comprises less than <br />ten percent (10%) of the gross income from the sale or <br />rental of goods or services at the establishment. Any <br />adult use activity other than the sale or rental of adult <br />material shall preclude the establishment's qualifying <br />solely as an adult bookstore and shall mandate its <br />classification as other than an adult bookstore. <br />However, it is an affirmative defense to an alleged <br />violation of this Ordinance regarding operating an adult <br />bookstore without an entertainment license if the alleged <br />violator shows that the adult material is accessible only <br />by employees and the gross income from the sale and/or <br />rental of adult material comprises less than ten percent <br />(10%) of the gross income from the sale and/or rental of <br />goods and/or services at the establishment. <br />SECTION II. That Ordinance 717, Section XIII, Advertising, is hereby <br />amended to read: <br />SECTION XIII. Advertising. <br />A. Advertisements, displays, or other promotional <br />materials for any adult entertainment establishments, <br />except as authorized and described within this Section, <br />shall not be shown or exhibited so as to be visible to <br />the public from any street, sidewalk, or other public <br />place. <br />-2- <br />
