ORDINANCE NO. 717 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />ORDINANCE NO. 513 REGULATING THE CONCENTRATION OF ADULT <br />ENTERTAINMENT ESTABLISHMENTS, SETTING FORTH LEGISLATIVE <br />FINDINGS; PROVIDING DEFINITIONS; PROVIDING DISTRICTS, PROHIBITED <br />LOCATIONS, MEASUREMENT OF DISTANCES, AND PROVISIONS FOR <br />NONCONFORMING USES; PROVIDING GENERAL RE- <br />QUIREMENTS/STANDARDS, ADVERTISING, AND DESCRIBING PROHIBITED <br />ACTS; PROVIDING PROHIBITION OF ADMISSION OF MINORS AND SALES TO <br />MINORS; PROVIDING PRESUMPTION; PROVIDING FOR LICENSED <br />PROVISIONS; PROVIDING EMPLOYEE PROVISIONS, PROVIDING SPECIFIC <br />REGULATIONS FOR ADULT CABARETS; PROVIDING FOR PENALTIES, <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF <br />THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. Authority: Purpose; Area of Enforcement. <br />This Ordinance is enacted under the Home Rule Power of the City of Casselberry, Florida, and <br />is enacted in the interest of the public health, peace, safety, morals, and general welfare of the citizens <br />and inhabitants of the City of Casselberry, Florida, to regulate businesses within the City of Casselberry, <br />Florida. <br />SECTION Il. Purpose. <br />It is the intent of the City of Casselberry, Florida, in enacting this Ordinance, to establish <br />reasonable and uniform regulations of commercial establishments that will reduce the adverse effects of <br />adult entertainment establishments upon the morals, manners, and property values of the citizens of the <br />City of Casselberry, Florida. <br />SECTION III. Findings of Fact. <br />The City Commission of the City of Casselberry, Florida, in the exercise of its police powers to <br />protect the public health, peace, safety, and general welfare and in response to the concerns of numerous <br />residents of the City of Casselberry, has, through public hearings, heard interested parties and citizens <br />for and against the proposed ordinance and has reviewed the Findings of Facts incorporated in Section <br />IA -16 in the Orange County, Florida, Adult Entertainment Code (1987) and the Findings and <br />Declarations as stated in the Whereas clauses in the Seminole County Adult Entertainment Code (1988); <br />thereupon, the City Commission of the City of Casselberry, Florida, finds that: <br />A. Establishments exist or may exist within the City of Casselberry, Florida, where books, <br />magazines, motion pictures, videos, prints, photographs, periodicals, records, novelties, and/or devices <br />which depict, illustrate, describe, or relate to specified sexual activities are possessed, displayed, <br />produced, exhibited, distributed, and/or sold. <br />
