RESOLUTION 22-3295 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE APPROVAL OF A RATE ADJUSTMENT IN ACCORDANCE WITH THE PIGGYBACK AGREEMENT FOR RESIDENTIAL SOLID WASTE COLLECTION WITH WASTE PRO OF FLORIDA, INC.; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, via Resolution 18-3005, the City entered into a piggyback agreement for solid waste collection services with Waste Pro of Florida, Inc. (Waste Pro); and WHEREAS, said agreement includes a rate adjustment matrix that provides for annual consideration of labor, equipment, and fuel; and WHEREAS, Seminole County agreed to calculate and provide the City with fuel inflation data bi-annually based on information provided by the U.S. Department of Labor, Bureau of Labor Statistics and the U.S. Energy Infonnation Administration; and WHEREAS, the City currently pays Waste Pro $15.04/home per month for regular and special collection services and $30.08/home per month for side -door collection services; and WHEREAS, based on recent calculations submitted by Seminole County, rates payable to Waste Pro iiir residential soiid waste collection will increase ii'orn $ 15.04 to "DI 6.34 per home per month (regular and special collection services) and from $30.08 to $32.68 per home per month (side -door collection services); and WHEREAS, the new rates payable to Waste Pro are effective January 1, 2022; and WHEREAS, Public Works staff has reviewed the CPI rate adjustment data submitted by Seminole County and recommend an adjustment accordingly. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves a rate adjustment payable to Waste Pro for residential solid waste collection, increasing the base rate per home per month from $15.04 to $16.34 for regular and special collection services and from $30.08 to $32.68 for side -door collection services, based on labor, equipment, and fuel inflation data provided by Seminole County. SECTION IL Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other• Section or part of this Resolution.
