ORDINANCE 22-1563 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY ADDING A PROPERTY RIGHTS ELEMENT IN ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, Section 163.3167, Florida Statutes, requires the City of Casselberry (City) to maintain a comprehensive plan to guide its future development and growth; and WHEREAS, Section 163.3177(6)(i)l., Florida Statutes, requires the City's Comprehensive Plan to include a property rights element; and WHEREAS, the City respects judicially acknowledged and constitutionally protected private property rights; and WHEREAS, Section 163.3184 of the Florida Statutes establishes a process for adoption of comprehensive plans or plan amendments; and WHEREAS, the Planning and Zoning Commission, as the City's Local Planning Agency, has held a public hearing with due public notice to consider this amendment to the City's Comprehensive Plan; and WHEREAS, a public hearing considering amendment of the City's Comprehensive Plan has been duly held by the City Commission of the City of Casselberry, Florida, and at such hearing, interested parties and citizens were heard; and WHEREAS, words with double underlined type shall constitute additions to the original text and stfike thfough type shall constitute deletions to the original text, and asterisks (* * *) indicate that text shall remain unchanged from the language existing prior to adoption of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission does hereby adopt Section 11 Property Rights Element into the City of Casselberry's Comprehensive Plan, attached hereto as Attachment "A". SECTION II. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed to the extent of the conflict.
