Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />December 8, 2021 <br />Page 2 <br />Fifth Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />Sixth Item of Business: SPR 21-14: Casselberry Center Phase 2 at 1391 SR 436. A major site plan request to <br />develop a ±2,391 sq. ft. drive through restaurant, as well as associated hardscape, landscaping, and site <br />lighting. <br />Ms. Christina Hyson, Chief Planner, reviewed the information provided in her memorandum dated December <br />8, 2021 to the City of Casselberry Planning and Zoning Commission. Ms. Hyson said staff recommends that the <br />Planning and Zoning Commission approve case number SPR 21-14, based on the staff report and the testimony and <br />evidence presented, that the request meets the applicable provisions of the Unified Land Development Regulations <br />and is consistent with the Comprehensive Plan as per the written findings in the staff report. The waiver request and <br />conditions of approval are as follows: <br />Waiver: <br />1. A waiver request to permit 11 of the 32 parking spaces (34.4%) on Lot 3 to be reduced sized parking <br />spaces at 10 ft. by 18 ft. <br />Conditions of Approval: <br />1. The site plan approval shall be valid for one (1) year. An extension request may be submitted prior to <br />the expiration of this approval. <br />2. A tree bank payment of $1,400.00 must be submitted prior to the issuance of a Certificate of <br />Occupancy. <br />3. Panda Express must execute an Encroachment Agreement in a form that is acceptable to the City for <br />the development over the easement. <br />4. Provide copies of all local, regional, state, and federal permits for the project to the City prior to <br />commencement of development. <br />5. All of the above conditions shall be fully and faithfully executed, or the site plan shall become null and <br />void. <br />In response to the Commission's question, the motion would include the waiver and the conditions of <br />approval. In response to the Commission's question, Ms. Hyson explained that the nine (9) parking spaces located <br />on the northern portion of the project would be constructed in Phase 2; however, the parking spaces would be used <br />for the Phase 3 development. In response to the Commission's question, Ms. Hyson stated that no parking spaces <br />would be dedicated for food delivery drivers or a drive through wait area. <br />A brief discussion ensued regarding the parking waiver and the width of the sidewalk. In response to the <br />Commission's question, Ms. Hyson stated that the ATM was approved as part of the site plan for Phase 1; however, <br />the ATM will be constructed on lot 2. She said a building permit has not been issued for the ATM. <br />
