RESOLUTION 06-1742 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AUTHORIZING THE CITY MANAGER TO <br />UTILIZE A MODEL EMPLOYMENT AGREEMENT WITH <br />DEPARTMENT DIRECTORS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, Sections 26 and 27 of the City's Charter and Section 2-106 of the <br />City's Code provide that the City Manager may, with the approval of the City <br />Commission, hire, suspend, or remove Department Directors; and <br />WHEREAS, the Interim City Manager desires to provide each current and <br />future Department Director with an Employment Agreement; and <br />WHEREAS, the City Commission has reviewed the attached proposed Model <br />Employment Agreement for Department Directors, and approves the use of that <br />Model Employment Agreement by the City Manager, with minor adjustments to be <br />made by the City Manager to reflect differences among Department Directors, such <br />as differences in tenure with the City; and <br />WHEREAS, the City Commission is hereby exercising its authority regarding <br />the employment of directors under the City Charter and Code through authorizing the <br />execution of the Model Employment Agreement; and <br />WHEREAS, by this action, the City Commission agrees to be bound by <br />Employment Agreements executed by the City Manager and the Department <br />Directors, so long as said Employment Agreements are substantially in the form <br />attached as Exhibit A. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Manager is authorized to execute Employment <br />Agreements with all current and future Department Directors in the form attached as <br />Exhibit A, the "City of Casselberry Model Employment Agreement for Department <br />Directors", and the City Manager is further authorized to make minor adjustments to <br />said Model Employment Agreement for each individual Department Director to reflect <br />differences in tenure with the City and other minor matters. <br />SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any <br />of the provisions of this Resolution are hereby repealed. <br />SECTION 3. Severability. If any Section or portion of a Section of this <br />Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to <br />
