<br />DECLARATION OF ACCESS AND BOAT RAMP EASEMENT
<br />THIS DECLARATION OF ACCESS AND BOAT RAMP EASEMENT (the "Declaration"),
<br />is made and entered into on this ' 94'11' day of 2022, by the CITY OF
<br />CASSELBERRY, FLORIDA, a Florida municipal corporation, of Triplet Lake Drive, Casselberry,
<br />FL 32707 (hereinafter referred to as "City").
<br />WITNESSETH:
<br />WHEREAS, City is the owner in fee simple of certain real property located in Seminole County,
<br />Florida more particularly described in Exhibit "A" attached hereto and made a part hereof, with an
<br />address of 329 Seminola Boulevard, Casselberry, FL 32707, and Tax Parcel ID 09-21-30-502-0000-
<br />0020 (hereinafter referred to as the "Lot 2 Property"); and
<br />WHEREAS, City is the owner in fee simple of the real property adjacent to the Lot 2 Property
<br />being more particularly described in Exhibit "B" attached hereto and made a part hereof, with an
<br />address of 335 Seminola Boulevard, Casselberry, FL 32707, and Tax Parcel ID 09-21-30-501-OB00-
<br />0000 (hereinafter referred to as the "Canal Property"); and
<br />WHEREAS, it is the intent of the City to subdivide the Lot 2 Property into two parcels ("Parcel
<br />1" and "Parcel 2") and to sell Parcel 1 and maintain ownership of Parcel 2, as depicted on Exhibit "C"
<br />and Exhibit "D"; and
<br />WHEREAS, Parcel 1 contains a home and certain existing improvements, including a boat
<br />ramp; and
<br />WHEREAS, the City desires to create and declare a perpetual non-exclusive access and boat
<br />ramp easement benefitting Parcel 2 and the Canal Property, for purposes of vehicular and pedestrian
<br />ingress and egress to and from the concrete boat ramp on Parcel 1 shown and described in Exhibit "E"
<br />("Easement Area"), and for all other uses expressly contemplated by this Declaration; and
<br />NOW, THEREFORE, City declares that Parcel 1 shall be held, transferred, sold, conveyed,
<br />leased, and mortgaged subject to the following easement, covenants, and conditions which are for the
<br />purposes of protecting the value and desirability of, and which shall run with Parcel 1 and be binding on
<br />all parties having any right, title or interest in Parcel 1 or any part hereof, their heirs, successors and
<br />assigns, and shall inure to the benefit of each owner thereof.
