Casselberry to exercise any power for municipal purposes except as otherwise provided by law and <br />Chapter 166, Florida Statutes, vests broad home rule authority in the City; and <br />WHEREAS, the City Commission of the City of Casselberry finds that it is appropriate and <br />furthers the public good to provide authorization for Seminole County to assess certain parcels and <br />collect, through uniform method the cost share allocation, for stabilization needs including, but is not <br />limited to, renovation and refurbishment of recreation facilities including renovation of the existing <br />clubhouse and parking area for use as a community center facility, drainage and other essential <br />facilities. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. Sections 78-3 and 78-4 of Article I of Chapter 78, Taxation, are hereby <br />created as follows: <br />Sec. 78-3. - APPROVAL OF INCLUSION OF CERTAIN PROPERTIES <br />LOCATED IN THE CITY OF CASSELBERRY IN THE MSBU. The City <br />Commission of the City of Casselberry, Florida, hereby approves and authorizes the <br />inclusion of Field Club and Hunter's Chase properties within the City into Seminole <br />County's Deer Run Municipal Service Benefit Unit boundaries, said properties more <br />fully described as set forth in Exhibit "A", [Exhibit "A" is not to be codified] <br />attached hereto and incorporated herein by reference. <br />Sec. 78-4. - TERM. This Ordinance shall remain in full effect for the duration of the <br />Deer Run MSBU or until such time as the Casselberry City Commission repeals Sec. <br />78-3 following procedures set out in Florida Statutes, Section 166.041, whichever <br />first occurs. Notice of the proposed repeal of Sec. 78-3 shall be provided in writing <br />to Seminole County no later than March I of the year in which the City intends to <br />terminate the County's services within the MSBU to avoid imposition of non -ad <br />valorem assessments for that tax year. <br />SECTION 2. CODIFICATION. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and <br />be made a part of the Code of Ordinances of the City of Casselberry, Florida; that the Sections of <br />this Ordinance may be renumbered or re -lettered to accomplish such intention; that the word, <br />"Ordinance" may be changed to "Section," "Article," or other appropriate word; providing however, <br />that Exhibit "A" shall not be codified. <br />SECTION 3. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of <br />the provisions of this Ordinance are hereby repealed. <br />SECTION 4. SEVERABILITY.
