subdivision thereof nor the faith and credit of the City are pledged to the payment of the <br />principal of or redemption premium, if any, or interest on the Series 2021 Bond, and the issuance <br />of the Series 2021 Bond shall not directly or indirectly or contingently obligate the State, or any <br />political subdivision thereof, or the City to levy any ad valorem taxes whatever therefor or to <br />make any appropriation for their payment except from the legally available Non -Ad Valorem <br />Revenues budgeted and appropriated by the City to the extent set forth herein and in the <br />Supplemental Resolution. <br />SECTION 7. GENERAL AUTHORITY. The Mayor, City Manager, and Finance <br />Director of the City, or any of them and such other officers and employees of the City as may be <br />designated by the Mayor are hereby authorized, pending adoption of the Supplemental <br />Resolution, to do all things and to take any and all actions on behalf of the City, without further <br />action by the Commission, to provide for the issuance of the Series 2021 Bond; to furnish <br />disclosures, representations, certifications and confirmations concerning the City; and to execute <br />and deliver any bank commitments regarding the Series 2021 Bond, and all other documents and <br />instruments deemed appropriate by any of such officers, the approval of the City and all <br />corporate power and authority for such actions to be conclusively evidenced by the execution <br />and delivery thereof by any of such officers. <br />SECTION 8. REPEAL OF INCONSISTENT PROVISIONS. All ordinances, <br />resolutions or parts thereof in conflict with this ordinance are hereby repealed to the extent of <br />such conflict. <br />SECTION 9. REMEDIES OF HOLDERS OF SERIES 2021 BOND. The holders of <br />the Series 2021 Bond, except to the extent the rights herein given may be restricted by a <br />supplemental resolution, may, whether at law or in equity, by suit, action, mandamus or other <br />proceeding, protect and enforce and compel the performance of all duties required hereby, or by <br />such supplemental resolution, to be performed by the City. <br />SECTION 10. ALTERNATIVE METHOD. This Ordinance shall be deemed to <br />provide an additional and alternative method for the doing of things authorized hereby and shall <br />be regarded as supplemental and additional to powers conferred by other laws, and shall not be <br />regarded as in derogation of any powers now existing or which may hereafter come into <br />existence. This Ordinance, being necessary for the health, safety and welfare of the inhabitants <br />and /or property owners of the City, shall be liberally construed to effect the purposes hereof. <br />SECTION 11. SEVERABILITY. In the event that any portion or section of this <br />Ordinance is determined to be invalid, illegal or unconstitutional by a court of competent <br />jurisdiction, such decision shall in no manner affect the remaining portions or sections of this <br />Ordinance which shall remain in full force and effect. <br />[Remainder of Page Intentionally Left Blank] <br />
