RESOLUTION 11-2277 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF AMENDMENT NO. 6 TO <br />SUPPLEMENTAL AGREEMENT NO. 3 TO THE CONTINUING <br />CONSULTING TRANSPORTATION ENGINEERING SERVICES <br />AGREEMENT WITH HNTB CORPORATION TO PROVIDE <br />ADDITIONAL PROFESSIONAL SERVICES FOR THE PHASE II <br />SEGMENT OF THE NORTH WINTER PARK DRIVE PROJECT; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE." <br />WHEREAS, the City currently has a continuing consulting services agreement with <br />HNTB Corporation (HNTB) to provide transportation planning and design services related to the <br />North Winter Park Drive (NWPD) Project; and <br />WHEREAS, the City recently received economic stimulus fiinding via a Local Agency <br />Program (LAP) agreement with the Florida Department of Transportation to construct Phase II of <br />the NWPD Project; and <br />WHEREAS, HNTB has submitted Amendment No. 6 to Supplement No. 3 of the <br />Agreement, not to exceed $25,000 without prior authorization, in order to provide additional <br />design services as needed, including to address design of pedestrian upgrades needed for <br />compliance with the Americans with Disabilities Act on the portion of Winter Park Drive from <br />Seminola Boulevard to south of Cannon Way; and <br />WHEREAS, Public Works staff has reviewed Amendment No. 6 to Supplemental <br />Agreement No. 3 from HNTB Corporation and finds it favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Amendment No. 6 to Supplemental Agreement No. 3 of the Agreement with HNTB Corporation, <br />in an amount not to exceed $25,000, (attached hereto as "Attachment A"), and authorizes <br />the Mayor to execute said document(s) on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
