RESOLUTION 11-2276 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF SUPPLEMENT NO. 37 TO THE <br />AGREEMENT FOR CONTINUING CONSULTING ENGINEERING <br />SERVICES WITH CPH ENGINEERS, INC. TO PROVIDE MITIGATION <br />COMPLIANCE SERVICES FOR THE GEE CREEK EROSION CONTROL, <br />NORTH WINTER PARK DRIVE, PLUMOSA AVENUE INTERSECTION <br />IMPROVEMENTS, AND LAKE CONCORD STORMWATER PARK <br />PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br />WHEREAS, the City currently has an agreement with CPH Engineers, Inc. to provide <br />consulting engineering services; and <br />WHEREAS, four projects recently completed in the City (Gee Creek Erosion Control, <br />North Winter Park Drive Phase 1, Plumosa Avenue Intersection Improvements, and Lake Concord <br />Stormwater Park) all require multi-year mitigation compliance reporting to the St. Johns River <br />Water Management District; and <br />WHEREAS, CPH Engineers, Inc. has provided the City satisfactory mitigation compliance <br />services for these projects previously; and <br />WHEREAS, CPH Engineers, Inc. has provided the proposed Supplement No. 37 to <br />provide such services through 2014, which will conclude the compliance reporting period; and <br />WHEREAS, Public Works staff has reviewed Supplement No. 37 from CPH Engineers, <br />Inc. and finds it favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Supplement No. 37 to the Agreement for Continuing Consulting Engineering Services with CPH <br />Engineers, Inc., in an amount not to exceed a total of $34,960 ($11,300 for 2011; $8,550 for 2012; <br />$8,550 for 2013; and $6,560 for 2014) without prior written authorization (attached hereto as <br />Attachment `A') and authorizes the Mayor to execute said document(s) on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawfiil, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
