The Special Magistrate asked if there was <br />anyone wishing to speak to this case, owner/trustee was present. <br />Edward Cerni„ 543 Tiberon Cove Rd; Longwood, FL trustee gave testimony and advised he was just <br />making a repair to the driveway and thought he did not need a permit. Mr. Cerni provided photos for the <br />magistrate to look at. A property survey submitted by Mr. Cerni was entered into record as exhibit A. Mr. <br />Cerni stated they made a repair to sixty four percent of the driveway, except for the street connector and <br />the code does not address repair. Mr. Cerni requested dismissal of the alleged violation. <br />Officer McDonald read the description for structure, which includes driveway. Officer McDonald also <br />stated that a separate permit and engineering permit will be required for the apron of the driveway. Ms. <br />Consalo stated the apron was her biggest concern. <br />Jen Nix, City Attorney stated that is a structure/driveway is being added to or structurally altered it needs a <br />permit. <br />The Special Magistrate made a finding that CE -20-002294, located at 332/334 Oleander Way, was in <br />violation of the City Code Section as listed on the notice of code violation, based on testimony and evidence <br />provided by the Code Enforcement Officer. It was ordered that the respondent shall cure the violation by <br />1:00 P.M. March 15, 2021. If there is no compliance by March 15, 2021, then a fine of $25.00 per day will <br />be imposed for each day the property remains in non-compliance. The City requested a <br />correction date of January 16, 2021. If no compliance by January 16, 2021, then a fine of $100.00 per day <br />should then be imposed for each day of non-compliance thereafter. The City requested a subsequent hearing <br />date of January 21, 2021 to determine compliance.
