Ms. Campbell seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: CU 20.09: 2COP at 1401 SR 436. A conditional use request to allow the sale of beer and wine <br />(2COP) for onsite consumption at Polio Tropical. <br />Mr. Tatum Jordan -Madden, Planning Technician, reviewed the information provided in his memorandum dated <br />November 18, 2020 to the City of Casselberry Planning and Zoning Commission. Mr. Jordan -Madden said staff recommends <br />case number CU 20-09 be approved with staffs conditions, based upon the staff report and the testimony and evidence <br />presented, that the request meets the applicable provisions of the Unified Land Development Regulations and is consistent <br />with the Comprehensive Plan as per the written findings contained within the staff report. He said the conditions of approval <br />are as follows: <br />1. The conditional use shall be limited to the location of 1401 State Road 436. <br />2. All sales and consumption of alcoholic beverages shall be on-site and either indoors or within the designated <br />outdoor patio dining area. <br />3. Package sales of alcoholic beverages for off-site consumption shall be permitted in accordance with the most <br />current local, state, and federal regulations and only as long as the applicant complies with those same <br />regulations. The alcoholic beverages sold shall be in the sealed and unopened original containers. <br />4. At least 51 percent of gross revenue shall be derived from the sale of food and nonalcoholic beverages. <br />5. The hours of on-site alcohol consumption and sales shall comply with the hours set forth in Section 10.2 of the <br />City of Casselberry's Code. <br />6. The business shall remain in compliance with all City, County and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services or vehicles. <br />8. The conditional use shall commence within 180 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />A brief discussion ensued regarding the City's outside seating requirements and package sales for restaurants and <br />the current changes to outdoor seating and package sale requirements due to the Executive Order for the pandemic. <br />Mr. Phillips asked the applicant to come forward. Ms. Yassalis Garcia, 1401 State Road 436, Casselberry, Florida <br />came forward. There were no questions for the applicant. <br />Mr. Phillips asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Phillips asked for a motion to address CU 20-09. Mr. Hale made a motion that the Planning and Zoning <br />Commission approve CU 20-09 for a 2COP license at 1401 State Road 436. The recommendation is based on the findings of <br />
