HOLD HARMLESS AND MAINTENANCE AGREEMENT <br />[LAKE BOTTOM DOCK CONSTRUCTION] <br />City of Casselberry <br />The undersigned property owner(s), Robert Clark Johnson, III, and Leslie Ann Johnson, husband <br />and wife (hereinafter "Property Owner"), whose address is 134 N. Lost Lake Lane, Casselberry, Florida <br />32707 (hereinafter "Property"), submitted a permit application for the construction of a fixed residential <br />boat dock (hereinafter "Dock") into the lake bottom known as Lost Lake, which is privately owned by the <br />Estate of Martha Casselberry (William P. Battaglia and Lilian Selph, co -personal representatives). Property <br />Owner expressly acknowledges and agrees both that the City of Casselberry makes no representations to <br />Property Owner regarding Property Owner's ownership rights relative to construction of the Dock, and that <br />the best evidence presented to the City of Casselberry at the time of receipt of the Property Owner's <br />application to construct the Dock indicated that the Property Owner is a lakefront owner. Property Owner <br />hereby agrees to indemnify and hold the City of Casselberry harmless from and against any and all claims, <br />losses, lawsuits, settlements, damages, costs and expenses, including attorneys' fees, arising out of the <br />construction, operation, or maintenance of the Dock located at the above address and extending into Lost <br />Lake. The Property Owner agrees to maintain the Dock in accordance with the City Code of Ordinances. <br />This Agreement is binding upon the Property Owner, their successors and assigns, lessees and all <br />other persons acquiring any interest in the Property, whether by operation of law or in any manner <br />whatsoever, including without limitation future owners of the Property, and shall inure to the benefit of the <br />Property Owner and the respective parcels and their heirs, successors and assigns.
