RESOLUTION 21-3258 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING EXECUTION OF THE AMERICAN RESCUE PLAN ACT CORONAVIRUS LOCAL FISCAL RECOVERY FUND AGREEMENT NUMBER Y5044 WITH THE STATE OF FLORIDA, DIVISION OF EMERGENCY MANAGEMENT; PROVIDING FOR CONFLICTS, SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Casselberry was, and continues to be, impacted by COVID-19; and WHEREAS, the American Rescue Plan Act of 2021 (ARPA) established the Coronavirus Local Fiscal Recovery Fund for the purpose of providing funds to local governments in order to facilitate the ongoing recovery from the COVID-19 pandemic; and WHEREAS, ARPA allocated $7,105,927,713 for the Local Fiscal Recovery Fund to be distributed to metropolitan cities, non -entitlement units of local government and counties in Florida; and WHEREAS, $1,416,425,123 of these funds was provided to the State of Florida for distribution to non -entitlement units of local governments; and WHEREAS, the City of Casselberry is considered a non -entitlement unit (NEU) and has been allocated $14,403,048 in Local Fiscal Recovery Funds; and WHEREAS, these funds will be disbursed in two traunches to the City of Casselberry in equal amounts of $7,201,524. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRRY, FLORIDA AS FOLLOWS: SECTION I. That the City Commission of the City of Casselberry hereby approves the American Rescue Plan Act Coronavirus Local Fiscal Recovery Fund Agreement Y5044 with the State of Florida, Division of Emergency Management and authorizes the City Manager to execute said agreement and related documents for and on behalf of the City of Casselberry. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
