RESOLUTION 21-3258 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING EXECUTION OF THE <br />AMERICAN RESCUE PLAN ACT CORONAVIRUS LOCAL FISCAL <br />RECOVERY FUND AGREEMENT NUMBER Y5044 WITH THE STATE <br />OF FLORIDA, DIVISION OF EMERGENCY MANAGEMENT; <br />PROVIDING FOR CONFLICTS, SEVERABILITY AND PROVIDING <br />FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry was, and continues to be, impacted by COVID-19; <br />and <br />WHEREAS, the American Rescue Plan Act of 2021 (ARPA) established the <br />Coronavirus Local Fiscal Recovery Fund for the purpose of providing funds to local <br />governments in order to facilitate the ongoing recovery from the COVID-19 pandemic; and <br />WHEREAS, ARPA allocated $7,105,927,713 for the Local Fiscal Recovery Fund to be <br />distributed to metropolitan cities, non -entitlement units of local government and counties in <br />Florida; and <br />WHEREAS, $1,416,425,123 of these funds was provided to the State of Florida for <br />distribution to non -entitlement units of local governments; and <br />WHEREAS, the City of Casselberry is considered a non -entitlement unit (NEU) and has <br />been allocated $14,403,048 in Local Fiscal Recovery Funds; and <br />WHEREAS, these funds will be disbursed in two traunches to the City of Casselberry in <br />equal amounts of $7,201,524. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRRY, FLORIDA AS FOLLOWS: <br />SECTION I. That the City Commission of the City of Casselberry hereby approves the <br />American Rescue Plan Act Coronavirus Local Fiscal Recovery Fund Agreement Y5044 with the <br />State of Florida, Division of Emergency Management and authorizes the City Manager to <br />execute said agreement and related documents for and on behalf of the City of Casselberry. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately <br />upon its passage and adoption. <br />
