RESOLUTION 21-3261 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AN AMENDMENT TO A CONSERVATION EASEMENT WITH ST. JOHNS RIVER WATER MANAGEMENT DISTRICT ASSOCIATED WITH THE LAKE KATHRYN CIRCLE COMPLETE STREET IMPROVEMENTS PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry owns property encumbered by an existing Conservation Easement dedicated to St. Johns River Water Management District, said Conservation Easement recorded in the Official Records of Seminole County Book 3861, Pages 346 through 361; and WHEREAS, an amendment to said Conservation Easement is required in order to authorize necessary water main work associated with the Lake Kathryn Circle Complete Street Improvements Project; and WHEREAS, an Amendment to the Conservation Easement, as provided in Attachment A, has been provided and approved by St. Johns River Water Management District to suit the City's needs; and WHEREAS, City staff has reviewed said Amendment to the Conservation Easement and finds it sufficient to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Amendment to the Conservation Easement, as provided in Attachment A, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
