their own agency's employment and shall not be construed to be acting as an <br />employee of any other agency. <br />G. If the Operational Plan fails to set forth the handling of secondary consequences, the <br />policy and procedure of the requesting agency will control, except if the requesting <br />agency's policy conflicts with the individual participant's employing agency, then the <br />individual participant shall follow his/her own employer's policy. <br />H. if a complaint is lodged against any participant officer/deputy, the complaint will be <br />forwarded to the Agency Head or his/her designee of the participating officer/deputy <br />agency to be handled pursuant to the policy and procedures of the employing agency. <br />I. The requesting agency will not be obligated to reimburse the assisting agencies for <br />rendering assistance as outlined in this Agreement. <br />J. A party will not have any liability because it does not provide services to the other <br />parties to this Agreement. Further, the assisting agency retains the right to withdraw <br />some or all of its resources at any time. Notice of intention to withdraw must be <br />communicated to the requesting agency's designated official as soon as practicable. <br />SECTION IV. INDEMNIFICATION <br />Each party agrees, with respect to any suit or claim for damages resulting from any and all <br />acts, omissions, or conduct of such party's own appointees/employees occurring while <br />engaging in rendering assistance pursuant to this Agreement, to hold harmless, defend, <br />and indemnify the other participating party and its appointees/employees, subject to the <br />provisions of Section 768.28, Florida Statutes, where applicable, and to the extent <br />permitted by law. Any party having a duty to indemnify and defend under this <br />Agreement shall have control of the defense of any suit or claim arising under said duty. <br />Each party shall be responsible for the acts, omissions, or conducts of its own employees. <br />Nothing in this Agreement shall be deemed a waiver of any party's sovereign immunity. <br />This Agreement is solely for the benefit of the parties hereto.
