ORDINANCE 21-1555 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />APPROVING A PLANNED UNIT DEVELOPMENT (PUD) AGREEMENT <br />AND CONCEPT PLAN FOR APPROXIMATELY 1.98 ACRES WITH <br />PMX-HIGH (PLANNED MIXED-USE: HIGH RISE) ZONING, <br />GENERALLY LOCATED ON THE NORTHEAST CORNER OF SOUTH <br />U.S. HIGHWAY 17-92 AND GRANDPINE WAY AS DESCRIBED IN <br />SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the zoning of the subject property shown in "Attachment A" and described <br />in "Attachment B" (Property) is PMX-HIGH (Planned Mixed -Use: High Rise) through <br />Ordinance 16-1437; and <br />WHEREAS, the previous zoning amendment designating the Property as PMX-HIGH <br />on the City of Casselberry (City) Official Zoning Map did not include the approval of a Planned <br />Unit Development (PUD) Agreement or an associated concept plan, which is required under the <br />Code; and <br />WHEREAS, the Owner has submitted a PUD Review Application and requested the <br />adoption of a PUD Agreement and an associated concept plan, attached hereto as "Attachment <br />B", in order to provide development standards for a proposed townhome development; and <br />WHEREAS, the PMX-HIGH zoning district is consistent with the City's Major <br />Thoroughfare Mixed -Use (MTMU) Future Land Use Map (FLUM) designation; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this PUD Agreement and the associated <br />concept plan; and <br />WHEREAS, a public hearing considering the PUD Agreement and concept plan has <br />been duly held in the City, and, at such hearing, interested parties and citizens were heard; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, determined that the PUD Agreement and associated concept plan are consistent with the <br />City's Comprehensive Plan and are in compliance with all applicable procedures of the Unified <br />Land Development Regulations of the City of Casselberry, Florida. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That the City Commission, pursuant to the Unified Land Development <br />Regulations of the Code of Ordinances of the City of Casselberry, Florida, hereby enacts this <br />Ordinance approving the PUD Agreement and associated concept plan, attached hereto as <br />
