ORDINANCE 21-1555 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING A PLANNED UNIT DEVELOPMENT (PUD) AGREEMENT AND CONCEPT PLAN FOR APPROXIMATELY 1.98 ACRES WITH PMX-HIGH (PLANNED MIXED-USE: HIGH RISE) ZONING, GENERALLY LOCATED ON THE NORTHEAST CORNER OF SOUTH U.S. HIGHWAY 17-92 AND GRANDPINE WAY AS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the zoning of the subject property shown in "Attachment A" and described in "Attachment B" (Property) is PMX-HIGH (Planned Mixed -Use: High Rise) through Ordinance 16-1437; and WHEREAS, the previous zoning amendment designating the Property as PMX-HIGH on the City of Casselberry (City) Official Zoning Map did not include the approval of a Planned Unit Development (PUD) Agreement or an associated concept plan, which is required under the Code; and WHEREAS, the Owner has submitted a PUD Review Application and requested the adoption of a PUD Agreement and an associated concept plan, attached hereto as "Attachment B", in order to provide development standards for a proposed townhome development; and WHEREAS, the PMX-HIGH zoning district is consistent with the City's Major Thoroughfare Mixed -Use (MTMU) Future Land Use Map (FLUM) designation; and WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a public hearing with due public notice to consider this PUD Agreement and the associated concept plan; and WHEREAS, a public hearing considering the PUD Agreement and concept plan has been duly held in the City, and, at such hearing, interested parties and citizens were heard; and WHEREAS, after said public hearing, the City Commission of the City of Casselberry, Florida, determined that the PUD Agreement and associated concept plan are consistent with the City's Comprehensive Plan and are in compliance with all applicable procedures of the Unified Land Development Regulations of the City of Casselberry, Florida. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That the City Commission, pursuant to the Unified Land Development Regulations of the Code of Ordinances of the City of Casselberry, Florida, hereby enacts this Ordinance approving the PUD Agreement and associated concept plan, attached hereto as
