RESOLUTION 21-3270 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND ADOPTING THE <br />AMERICANS WITH DISABILITIES ACT (ADA) EVALUATION AND <br />TRANSITION PLAN FOR THE CITY OF CASSELBERRY; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry is committed to making its community safer, more <br />comfortable, and more connected for people of all ages and abilities to walk, roll, and bike; and <br />WHEREAS, pursuant to the requirements of the Americans with Disabilities Act (ADA), <br />the City conducted a self-evaluation of its public building and pedestrian facilities, which resulted in <br />identification of various ADA deficiencies; and <br />WHEREAS, based on the self-evaluation, the City developed a transition plan, which <br />includes a 20 -year ADA improvement plan schedule to address the deficiencies; and <br />WHEREAS, a draft document including the self-evaluation and transition plan was made <br />available to the public and presented to the City Commission for feedback; and <br />WHEREAS, based on feedback received, the draft document has been revised into the final <br />Americans with Disabilities Act (ADA) Evaluation and Transition Plan; and <br />WHEREAS, staff has reviewed the final ADA Evaluation and Transition Plan and finds it <br />acceptable to meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves and adopts <br />the Americans with Disabilities Act (ADA) Evaluation and Transition Plan and directs the City <br />Manager to implement the ADA hnprovement Plan contained therein. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective inunediately upon <br />its passage and adoption. <br />PASSED and ADOPTED this �V day of A �% < , AD 2021. <br />
