RESOLUTION 21-3270 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND ADOPTING THE AMERICANS WITH DISABILITIES ACT (ADA) EVALUATION AND TRANSITION PLAN FOR THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry is committed to making its community safer, more comfortable, and more connected for people of all ages and abilities to walk, roll, and bike; and WHEREAS, pursuant to the requirements of the Americans with Disabilities Act (ADA), the City conducted a self-evaluation of its public building and pedestrian facilities, which resulted in identification of various ADA deficiencies; and WHEREAS, based on the self-evaluation, the City developed a transition plan, which includes a 20 -year ADA improvement plan schedule to address the deficiencies; and WHEREAS, a draft document including the self-evaluation and transition plan was made available to the public and presented to the City Commission for feedback; and WHEREAS, based on feedback received, the draft document has been revised into the final Americans with Disabilities Act (ADA) Evaluation and Transition Plan; and WHEREAS, staff has reviewed the final ADA Evaluation and Transition Plan and finds it acceptable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves and adopts the Americans with Disabilities Act (ADA) Evaluation and Transition Plan and directs the City Manager to implement the ADA hnprovement Plan contained therein. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective inunediately upon its passage and adoption. PASSED and ADOPTED this �V day of A �% < , AD 2021.
