Gardner, City Clerk <br />FORMAT FOR PROCEEDINGS: This is a public hearing. These proceedings are quasi-judicial in nature. <br />Formal rules of evidence shall not apply, but fundamental due process shall be observed and shall govern <br />all proceedings. All testimony shall be under oath and shall be recorded. At the conclusion of each hearing, <br />the Code Enforcement Special Magistrate shall issue Findings of Fact, based on the evidence of record and <br />conclusions of law, and shall issue an order affording the proper relief consistent with the powers of the <br />Special Magistrate. The order may include a notice that it must be complied with by a specified date, and <br />that a fine may be imposed. All participants must have an active role in the case, for example: Special <br />Magistrate, staff, respondent and/or witness. <br />Persons are advised that if they decide to appeal any decisions made at these meetings/hearings they will <br />need a record of the proceedings and for such purpose, they may need to ensure that a verbatim record of <br />the proceedings is made which record includes the testimony and evidence upon which the appeal is to be <br />based per Section 286.0105, Florida Statutes. <br />
