ORDINANCE 21-1554 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />REPEALING ORDINANCE 10-1311 THAT ESTABLISHED <br />RESIDENTIAL SOLID WASTE FEES AND CHARGES; PROVIDING <br />FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. <br />WHEREAS, Ordinance 10-1311 authorized a Franchise Agreement with Waste Pro of <br />Florida, Inc., and also, established rates for residential solid waste customers; and <br />WHEREAS, the Franchise Agreement with Waste Pro of Florida, Inc. approved with <br />Ordinance 10-1311 has sunset; and <br />WHEREAS, the City Commission desires to repeal Ordinance 10-1311 to ensure <br />consistency with City Code Section 70-51 which requires that rates for residential solid waste <br />collection be set by resolution; and <br />WHEREAS, Resolution 21-3242 provides for new rates effective October 1, 2021. <br />NOW, THEREFORE, BE IT ENACTED BY THE COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. REPEAL. Ordinance 10-1311 is hereby repealed. <br />SECTION H. CONFLICTS, All Ordinances or Resolutions, or nnrtc of Ordinanoes or <br />Resolutions in conflict with any provisions of this Ordinance are hereby repealed to the extent of <br />the conflict. <br />SECTION IH. SEVERABILITY. If any Section or portion of a Section of this <br />Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Ordinance. <br />SECTION IV. EFFECTIVE DATE.
