RESOLUTION 21-3225 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING A FORCE MAIN AND ACCESS EASEMENT AGREEMENT WITH JEFFERSON LAKE HOWELL, LLC AND RELATED BILL OF SALE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, Jefferson Apartments, owned by Jefferson Lake Howell, LLC, is a portion of Lot 1, Section 21 and 22, Township 21, South, Range East Seminole County, Florida in that certain plat of Jefferson Lake Howell recorded in the Seminole County Public Record Plat Book 84 Page 67; and WHEREAS, the wastewater collection system constructed within, is privately owned by Jefferson Lake Howell, LLC; and WHEREAS, a South Seminole North Orange County Wastewater Transmission Authority (SSNOCWTA) -owned lift station and force main, that will be operated and maintained by the City of Casselberry, was installed on this property in order to transport the collected wastewater from the site to the City of Orlando's Iron Bridge Wastewater Treatment Facility; and WHEREAS, in accordance with SSNOCWTA's Enabling Act, only member entities are permitted to discharge into a SSNOCWTA-owned lift station; and WHEREAS, Jefferson Lake Howell, LLC has prepared a Bill of Sale granting ownership of a manhole and a portion of gravity sewer main to the City of Casselberry in order to comply with SSNOCWTA's Enabling Act; and WHEREAS, a Force Main and Access Easement Agreement is necessary to convey non- exclusive easement access over the SSNOCWTA lift station and force main, and newly City -owned manhole and portion of gravity sewer line on the Jefferson Lake Howell property; and WHEREAS, City staff has reviewed the Force Main and Access Easement Agreement and the related Bill of Sale and have found them favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Force Main and Access Easement Agreement with Jefferson Lake Howell, LLC for utility lines at Jefferson Apartments and the related Bill of Sale, attached herewith, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
