<br />CORRECTIVE AND AMENDED DRAINAGE EASEMENT
<br />THIS CORRECTIVE AND AMENDED DRAINAGE EASEMENT is made and entered
<br />thisj,LP, day of A 17<i 1 , 2021, by LYNNE J. STEVENS, a single woman, whose
<br />address is 328 Sem vola Blvd., Casselberry, Florida 32707-3052, hereinafter referred to as the
<br />Grantor, and CITY OF CASSELBERRY, a Florida municipal corporation, whose address is 95
<br />Triplet Lake Drive, Casselberry, Florida 32707, hereinafter referred to as the Grantee;
<br />WITNESSETH:
<br />WHEREAS, Grantor is the owner of that certain real property located in Casselberry,
<br />Seminole County, Florida, more particularly described as set forth on Exhibit "A" attached
<br />hereto and incorporated herein by this reference (the "Property"); and
<br />WHEREAS, Grantor, along with her spouse, previously conveyed a drainage easement to
<br />Grantee, by easement dated May 12, 1972, and recorded in O.R. Book 941, Pages 686-687, in the Public
<br />Records of Seminole County, Florida, which contained an error in the legal description of the Easement
<br />Area on Lot 8, and the parties now want to correct that prior easement's legal description, and extend the
<br />drainage easement to Lot 9; and
<br />WHEREAS, Grantor, the current owner following the death of her spouse, desires to grant
<br />and convey unto Grantee this exclusive, perpetual, permanent easement and right-of-way for
<br />drainage purposes with full authority to enter upon, desiltrate, sump, excavate, construct, and
<br />maintain, as the GRANTEE and its assigns may deem necessary, a drainage system consisting
<br />of pipes, detention, percolation or disposal areas or combination thereof, together with appurtenant
<br />drainage structures, over, under, upon and through that certain portion of the Property which is
<br />described on Exhibit "B" attached hereto (hereinafter referred to as the "Easement Area"), to
<br />replace the prior easement, in order to correct the legal description of the Easement Area and to extend
<br />it to Lot 9.
<br />NOW, THEREFORE, for and in consideration of the mutual covenants and agreements
<br />contained herein and other good and valuable consideration, the receipt and sufficiency of which are
<br />hereby acknowledged, Grantor and Grantee hereby agree as follows:
<br />1. Recitals. The foregoing recitals are true and correct and are incorporated herein by
<br />this reference.
