RESOLUTION 21-3234 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE CONVEYANCE AND ACCEPTANCE OF A CORRECTIVE AND AMENDED DRAINAGE EASEMENT ON LOT 8 AND LOT 9, SECRET LAKE ADDITION TO CASSELBERRY, PARCEL ID'S 09-21-30-505-0000-0080 AND 09-21-30-505- 0000-0090; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry has an existing major drainage pipe that runs across portions of Lot 8 and Lot 9, Secret Lake Addition to Casselberry, Parcel ID's 09-21-30-505-0000- 0080 and 09-21-30-505-0000-0090; and WHEREAS, a previous drainage easement dedicated to the City of Casselberry dated May 12, 1972 and recorded in Seminole County Official Records Book 941, Pages 686-687, contained an error in legal description and does not fully encompass the existing drainage infrastructure; and WHEREAS, a Corrective and Amended Drainage Easement has been executed by the owner of Lot 8 and Lot 9, Secret Lake Addition to Casselberry, Parcel ID's 09-21-30-505-0000- 0080 and 09-21-30-505-0000-0090, as provided in Attachment A; and WHEREAS, City staff has reviewed said easement and find it sufficient to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION L The City Commission of the City of Casselberry hereby approves the conveyance and acceptance of a Corrective and Amended Drainage Easement on Lot 8 and Lot 9, Secret Lake Addition to Casselberry, Parcel ID's 09-21-30-505-0000-0080 and 09-21-30-505-0000- 0090, as provided in Attachment A, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or pail of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
