RESOLUTION 21-3227 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AN AMENDED AGREEMENT WITH THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION TO ASSIST WITH FUNDING A PORTION OF UTILITY - RELATED IMPROVEMENTS FOR THE LAKE KATHRYN CIRCLE UTILITY AND ROADWAY IMPROVEMENT PROJECT (ALSO KNOWN AS PROJECT PW 1805 LAKE KATHRYN CIRCLE COMPLETE STREET IMPROVEMENTS); PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the City of Casselberry's adopted Multimodal Transportation Master Plan includes programming of the Lake Kathryn Circle Complete Street Improvements project to improve pedestrian connectivity and safety; and WHEREAS, as part of this project, the City wishes to simultaneously construct various water and sewer utility improvements, the latter of which present an opportunity to add lakefront homes to the City's sanitary sewer system, thereby potentially reducing pollutant loads to the lake and downstream waterbodies due to septic tanks; and WHEREAS, in August 2020 the City of Casselberry applied to the Florida Department of Environmental Protection (FDEP) to consider providing funding assistance for utility -related improvements associated with the project; and WHEREAS, the State of Florida has appropriated funding for various water protection grants during State Fiscal year 2020-21; and WHEREAS, FDEP has informed the City that it has been awarded grant funding and has provided the City a proposed amended Agreement to execute the project under the teens of the grant; and WHEREAS, City staff has reviewed the aforementioned Agreement and finds it acceptable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission hereby approves amended Agreement #LPR0012 with the State of Florida Department of Environmental Protection to provide financial assistance for utility -related improvements associated with the Lake Kathryn Circle Utility and Roadway Improvements Project (also known as Project PW 1805 Lake Kathryn Circle Complete Complete Street Improvements) with the total project amount not to exceed $1,615,107.00, inclusive of a proposed local match not to exceed $807,553.50, and authorizes the Mayor to execute said document, attached herewith, on behalf of the City.
