RESOLUTION 21-3232 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A THREE PARTY ESCROW AGREEMENT WITH THE <br />STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND THE <br />STATE OF FLORIDA DEPARTMENT OF FINANCIAL SERVICES <br />DIVISION OF TREASURY IN ORDER TO PROVIDE FOR <br />CONSTRUCTION ENGINEERING AND INSPECTION SERVICES FOR <br />THE QUAIL POND CIRCLE CONNECTIVITY PROJECT; PROVIDING <br />FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry is committed to making its community safer, more <br />comfortable, and more connected for people of all ages and abilities to walk and bike; and <br />WHEREAS, in 2014 the City submitted an application to MetroPlan Orlando to request <br />funding for the Quail Pond Circle Connectivity Improvements project, which includes pedestrian <br />connectivity improvements along Quail Pond Circle and a new shared use path connection to North <br />Sunset Drive; and <br />WHEREAS, in 2016 as part of its adopted Multimodal Transportation Master Plan, the City <br />committed local funding for the aforesaid project, also known as Project PW 1701 Quail Pond <br />Circle Complete Street/Pedestrian Connectivity Improvements; and <br />WHEREAS, the proposed improvements have been programmed in the State of Florida <br />Department of Transportation's (FDOT's) Work Program for State Fiscal Year 2020-2021; and <br />WHEREAS, the City has locally funded and completed the design of the proposed <br />improvements and also has budgeted funding to assist with construction; and <br />WHEREAS, FDOT is prepared to undertake construction engineering and inspection (CEI) <br />services for the project and has partially funded said services; and <br />WHEREAS, a Locally Funded Agreement with FDOT is necessary in order for the City to <br />provide partial funding for CEI services using local funds; and <br />WHEREAS, a related Three Party Escrow Agreement with FDOT and the State of Florida <br />Department of Financial Sei vices Division of Treasury is also necessary to facilitate transfer of local <br />funds; and <br />WHEREAS, City staff has reviewed the aforementioned Three Party Escrow Agreement <br />and finds it acceptable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Three <br />Party Escrow Agreement with the State of Florida Department of Transportation and the State of <br />
