RESOLUTION 21-3232 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF A THREE PARTY ESCROW AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION AND THE STATE OF FLORIDA DEPARTMENT OF FINANCIAL SERVICES DIVISION OF TREASURY IN ORDER TO PROVIDE FOR CONSTRUCTION ENGINEERING AND INSPECTION SERVICES FOR THE QUAIL POND CIRCLE CONNECTIVITY PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry is committed to making its community safer, more comfortable, and more connected for people of all ages and abilities to walk and bike; and WHEREAS, in 2014 the City submitted an application to MetroPlan Orlando to request funding for the Quail Pond Circle Connectivity Improvements project, which includes pedestrian connectivity improvements along Quail Pond Circle and a new shared use path connection to North Sunset Drive; and WHEREAS, in 2016 as part of its adopted Multimodal Transportation Master Plan, the City committed local funding for the aforesaid project, also known as Project PW 1701 Quail Pond Circle Complete Street/Pedestrian Connectivity Improvements; and WHEREAS, the proposed improvements have been programmed in the State of Florida Department of Transportation's (FDOT's) Work Program for State Fiscal Year 2020-2021; and WHEREAS, the City has locally funded and completed the design of the proposed improvements and also has budgeted funding to assist with construction; and WHEREAS, FDOT is prepared to undertake construction engineering and inspection (CEI) services for the project and has partially funded said services; and WHEREAS, a Locally Funded Agreement with FDOT is necessary in order for the City to provide partial funding for CEI services using local funds; and WHEREAS, a related Three Party Escrow Agreement with FDOT and the State of Florida Department of Financial Sei vices Division of Treasury is also necessary to facilitate transfer of local funds; and WHEREAS, City staff has reviewed the aforementioned Three Party Escrow Agreement and finds it acceptable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I.
