Vinas , (hereinafter referred to as "Owner") whose address is <br />644 Field Club Circle, Casselberry, FL 32707 <br />WHEREAS, Owner presently owns that certain property generally described as Lot 0 <br />Field Club, accordingto o the plat as recorded in Plat Book 50 , Page 32 in the public <br />records of Seminole County, Florida, having a street address of 644 Field Club Circle, <br />Casselberry, FL 32707 , in Seminole County, Florida (the "Property"), which Property is <br />being serviced by the City's water and sewer facilities; and <br />WHEREAS, the City has a utility easement located on the Property which services the <br />Property as well as other properties; and <br />WHEREAS, Owner owns a shed_ which encroaches into the City's 15' utility easement <br />as recorded in Plat Book _50 Page 32 , Public Records of Seminole County, Florida (hereinafter <br />"Easement"); and <br />WHEREAS, the parties hereto wish to enter into this Agreement to allow the <br />shed to encroach into the City's Easement, subject to the conditions of this Agreement. <br />NOW, THEREFORE, in consideration of the terms and conditions set forth herein, the <br />parties agree as follows: <br />1. The "whereas" clauses set forth above are true and accurate and are hereby <br />incorporated herein. <br />2. The City hereby authorizes and allows Owner's shed to encroach into the <br />City's Utility Easement, but only to the extent as approved in DRC on January 21, 2021. Attached <br />as Exhibit A is a certified sketch of the encroachment. <br />3. Owner agrees to ensure that the Owner and the shed_ do not damage the <br />utilities located in the Easement.
