RESOLUTION 21-3222 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, CONDEMNING THE VIOLENCE AT THE <br />CAPITOL ON JANUARY 6, 2021 AND SPEECH INCITING RIOTS; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the Congress of the United States is required to convene in a joint session <br />on the sixth day of January following a presidential election to open, read, and count the votes of <br />the Electors for President and Vice President pursuant to the Constitution and U.S. Code; and <br />WHEREAS, the 117"' Congress convened in such a joint session at the United States <br />Capitol on January 6, 2021 to perform such duties; and <br />WHEREAS, a group of individuals infiltrated the United States Capitol in an attempt to <br />disrupt this process resulting in the deaths of five Americans including Capitol Police Officer <br />Brian D. Sicknick, destruction of property, and threats to members of Congress; and <br />WHEREAS, peaceful protests are protected by the Constitution of the United States <br />through an individual's First Amendment rights of freedom of speech, peaceful assembly, and <br />petitioning the Govermnent concerning grievances. However, violent acts of aggression and <br />speech inciting riots are not protected free speech, have no place in American democracy and <br />must be strongly condemned. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. The City Commission: <br />a) Strongly condemns the actions of the individuals who participated in the violent <br />attack on the U.S. Capitol Building on January 6, 2021 and those who spoke with the intention of <br />inciting the attack, which is also a violation of law. <br />b) Recognizes that peaceful protests are protected by the United States Constitution <br />and denounces all violent protests. <br />C) Urges peace, unity and tolerance by all citizens. <br />SECTION 2. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION 3. Severability. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br />
