CASSELBERRY CITY COMMISSION <br />Minutes of November 16, 2020 — Regular Mecting <br />Page 12 of 22 <br />Mr. Richard Henderson, 127 Mark David Boulevard, inquired in relation to Ms. Reischmann's <br />earlier comments regarding Homeowners' Associations (HOA's), whether his neighborhood, <br />which does not have an HOA but has all underground utilities, would be subject to placement <br />of telecommunications poles and equipment every 200 feet in their rights -of way. Ms. <br />Reischmann responded that most likely in that case the telecommunications companies would <br />have to place their equipment underground unless they could prove that there was no way to <br />provide service if the equipment was placed underground. <br />No one else came forward to address Ordinance 20-1545. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 20-1545 on first <br />reading, as presented. Motion was seconded by Commissioner Busch. Motion <br />carried unanimously by voice vote 5-0. <br />B. Ordinance 20-1546 — Amending Section 2-7.36, Communication Tower <br />Communication Antenna, and Wireless Communication Facility Regulations of <br />the Unified Land Development Regulations (LPA 20-05) <br />The City Clerk read Ordinance 20-1546 by title, as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />COMMUNICATION FACILITIES; AMENDING PART III, UNIFIED LAND DEVELOPMENT <br />REGULATIONS OF THE CITY OF CASSELBERRY CODE OF ORDINANCES BY AMENDING <br />SECTION 2-7.36, "COMMUNICATION TOWER, COMMUNICATION ANTENNA, AND <br />WIRELESS COMMUNICATION FACILITY REGULATIONS" WITHIN ARTICLE VII, <br />"GENERAL REGULATIONS" OF CHAPTER II, "DISTRICT AND GENERAL REGULATIONS" <br />TO UPDATE THESE SECTIONS IN ACCORDANCE WITH LEGISLATIVE CHANGES; AND <br />BY AMENDING SECTION 5-21.2, "DEFINITION OF TERMS" WITHIN ARTICLE XXI, <br />"LANGUAGE AND DEFINITIONS" OF CHAPTER V, "GLOSSARY" TO MOVE OR DELETE <br />CERTAIN DEFINITIONS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY <br />AND AN EFFECTIVE DATE." <br />Staff Presentation: There was no staff presentation for this item. Information relating to Ordinance 20- <br />1546 was included in the presentation given by City Attorney Katie Reischmann for the agenda item <br />immediately preceding this one. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 20-1546 on first reading. <br />Audience Participation: No one came forward to address Ordinance 20-1546. <br />MOTION: Commissioner Aramendia moved to approve Ordinance 20-1546 on first <br />reading, as presented.
