Planning & Zoning Commission/ <br />Local Planning Agency Minutes <br />August 12, 2020 <br />Page 2 <br />Fifth Item of Business: LPA 20.05: Wireless Code Amendments. An ordinance to amend Section 2-7.36, <br />Communication Tower, Communication Antenna, and Wireless Communication Facility Regulations, and <br />Section 5-21.2, Definition of Terms, in the Unified Land Development Regulations to update these sections in <br />accordance with legislative changes. <br />Ms. Neysa Borkert, Assistant City Attorney, reviewed the information provided in Ms. Katie Reischmann's <br />memorandum dated August 12, 2020 to the City of Casselberry Planning and Zoning Commission. Ms. Borkert <br />stated that there were two ordinances included in the agenda packet. She explained that one ordinance pertains to <br />the changes to the Unified Land Development Regulations (ULDR) and the second ordinance pertains to changes <br />made to the Code of Ordinances. She said both ordinances relate to small wireless facilities located in the city's <br />rights-of-way. Ms. Borkert reviewed the following proposed changes to the ULDR section of the Code: <br />1. Includes references to Chapter 68 of the Code of Ordinances <br />2. Includes references to the Florida Statutes — Section 337.401 <br />3. Updates definition of communication tower <br />4. Moves the definitions that were in the ULDR to Code of Ordinances - Chapter 68 <br />Ms. Borkert explained that the Planning and Zoning Commission would only review changes to the ULDR <br />and not changes to the Code of Ordinances. Ms. Borkert stated that the proposed revisions to the Code of <br />Ordinances (Exhibit B) was included in the agenda packet for informational purposes only. <br />After a brief discussion, Ms. Borkert requested a recommendation from the Planning and Zoning <br />Commission to recommend approval of LPA 20-05 to the City Commission. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. No one came forward. <br />Mr. Henson asked for a motion to address LPA 20-05. Mr. Hale made a motion that the Planning and <br />Zoning Commission provide a favorable recommendation of approval to the City Commission for LPA 20-05 based <br />on the report dated August 12, 2020 including Attachments A and B. Mr. Tizzio seconded the motion. The motion <br />passed unanimously by voice vote. <br />Sixth Item of Business: CU 20.04: Jefferson Lake Howell — Residential Boat Dock. A request to consider a <br />conditional use to allow a fixed residential boat dock for the Jefferson Lake Howell apartment complex at <br />1124 Shoreview Circle. <br />
