requested a subsequent hearing date of November 19, 2020 to determine compliance. The Special <br />Magistrate asked if there was anyone wishing to speak to this case, no one was present. <br />The Special Magistrate made a finding that CE -20-002041, located at 251 S. Embrey Dr., was in <br />violation of the City Code Section as listed on the notice of code violation, based on testimony and <br />evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure <br />the violation by 1:00 P.M. November 14, 2020. If there is no compliance by November 14, 2020, <br />then a fine of $75.00 per day will be imposed for each day the property remains in non-compliance. <br />A subsequent hearing will be held on November 19, 2020 to determine if compliance has been <br />achieved. <br />SUBSEQUENT CASE IN COMPLIANCE- NO FINES TO BE IMPOSED <br />CE -19-002651 36 Bayberry Branch <br />Right of way utilization permit, City Code 68-141 <br />Supervisor Campbell advised that case 19-002651, located at 36 Bayberry Branch was in <br />compliance by the date set by the Magistrate and no fines should be imposed. <br />The Special Magistrate advised that in addition to Supervisor Campbell's testimony, she also had <br />an affidavit of compliance from Officer Acevedo, indicating the property was in compliance. <br />Based upon testimony and the affidavit, it was found that the property at 36 Bayberry Branch was <br />in compliance and no fines should be imposed. <br />CASES WITHDRAWN FROM HEARING <br />CE -20-000231 673 Sausalito Blvd. -withdrawn <br />CE -20-000328 660 Crestview Dr. -complied <br />CE -20-002131 236 Plaza Oval Dr. -withdrawn <br />Supervisor Campbell advised that the cases listed above were not going to be heard at the October <br />15, 2020 Code Compliance hearing.
