Officer McDonald provided testimony and read case information into record. The City requested <br />a correction date of January 18, 2021. If no compliance by January 18, 2021, then a fine of $75.00 <br />per day should then be imposed for each day of non-compliance thereafter. The City requested a <br />subsequent hearing date of January 21, 2021 to determine compliance. The Special Magistrate <br />asked if there was anyone wishing to speak to this case, no one was present. <br />The Special Magistrate made a finding that CE-20-002180, located at 1164 Park Dr., was in <br />violation of the City Code Section as listed on the notice of code violation, based on testimony and <br />evidence provided by the Code Enforcement Officer. It was ordered that the respondent shall cure <br />the violation by 1:00 P.M. January 18, 2021. If there is no compliance by January 18, 2021, then <br />a fine of $75.00 per day will be imposed for each day the property remains in non-compliance. If there is no compliance by December 19, 2020, <br />then a fine of $250.00 per day will be imposed for each day the property remains in non- <br />compliance. A subsequent hearing will be held on January 21, 2021 to determine if compliance <br />has been achieved. <br />SUBSEQUENT CASE NOT IN COMPLIANCE- FINES TO BE IMPOSED <br />CE -20.-002041 251 S Embrey Dr. <br />• Carport, front porch, or porte-cochere storage, City Code 3-10.3.c.6 <br />Supervisor Campbell advised that case 19-002041, located at 251 S Embrey Dr. was not in <br />compliance by the date set by the Magistrate and fines should be imposed as ordered. <br />The Special Magistrate advised that in addition to Supervisor Campbell's testimony, she also had <br />an affidavit of non-compliance from Officer McDonald, indicating the property was not in <br />compliance. Based upon testimony and the affidavit, it was found that the property at 251 S. <br />Embrey Dr. Branch was not in compliance and fines of $75.00 per day should be imposed, <br />beginning November 14, 2020 and will accrue until there is compliance. <br />CASES WITHDRAWN FROM HEARING <br />31 Page <br />
