ORDINANCE 20-1539 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />PROVIDING FOR A CHANGE OF THE FUTURE LAND USE <br />DESIGNATION FROM SEMINOLE COUNTY HIGH DENSITY <br />RESIDENTIAL TO CITY OF CASSELBERRY MEDIUM DENSITY <br />RESIDENTIAL FOR APPROXIMATELY 21.41 ACRES LOCATED AT <br />3110 HOWELL BRANCH ROAD AND 3128 ORAVA LANE, AS <br />DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />TRANSMITTAL OF THE PLAN AMENDMENT TO THE DEPARTMENT <br />OF ECONOMIC OPPORTUNITY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") was <br />recently annexed into the City of Casselberry (City) corporate boundaries by Ordinance 20-1535; <br />and <br />WHEREAS, the Property consists of Parcel 34-21-30-300-0100-0000 and Parcel 34-21- <br />30-300-010B-0000, which are adjacent and share a common ownership; and <br />WHEREAS, the Property has a Seminole County Future Land Use Map (FLUM) <br />designation of High Density Residential; and <br />WHEREAS, the Property needs a City FLUM designation; and <br />WHEREAS, to allow for appropriate future development, the Property should be <br />developed consistent with the land uses of neighboring parcels; and <br />WHEREAS, the Property is greater than 10 acres, requiring a large-scale amendment to <br />the Comprehensive Plan; and <br />WHEREAS, Section 163.3184 of the Florida Statutes establishes a process for adoption <br />of comprehensive plans or plan amendments; and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this FLUM amendment; and <br />WHEREAS, a public hearing considering amendment of the FLUM designation for the <br />property hereinafter described, has been duly held by the City Commission of the City of <br />Casselberry, Florida, and at such hearing, interested parties and citizens were heard; and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, considered the Comprehensive Plan amendment and determined that the Future Land Use <br />designation of the Property, consisting of approximately 21.41 acres, shall be established as <br />Medium Density Residential, as defined in Future Land Use Element Objective FLU 1, as <br />amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and <br />WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the <br />Florida Statutes. <br />
