areas by maintaining allowable standards for location, design, landscape screening, and compatibility in <br />accordance with Section 337.401 et seq., Florida Statutes, which addresses, inter alia, the authority of <br />municipalities to regulate the placement and maintenance of communications facilities in the public <br />rights-of-way; and <br />WHEREAS, at its regularly scheduled meeting of August 12, 2020, the Planning and Zoning <br />Commission held a public hearing with due public notice to consider the proposed amendments to the <br />Unified Land Development Regulations, and recommended to the City Commission that the provisions <br />of this ordinance are consistent with the applicable provisions of the City's adopted comprehensive plan, <br />are in the best interest of the public health, safety, and welfare, are in harmony with the purpose and <br />intent of the City's Unified Land Development Regulations, and will not result in disorderly and <br />incompatible land uses; and <br />WHEREAS, the City Commission of the City of Casselberry finds that this ordinance promotes <br />the general welfare and is in the best interests of the citizenry of Casselberry and the general public; and <br />WHEREAS, words with double -underlined type shall constitute additions to the original text <br />and strike through type shall constitute deletions to the original text, and asterisks (* * *) indicate that <br />text shall remain unchanged from the language existing prior to adoption of this Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. LEGISLATIVE FINDINGS. The above recitals are hereby adopted as the <br />legislative findings of the City Commission. The City Commission finds and determines that there <br />is competent substantial evidence to support the findings and determinations made in this Section. <br />SECTION II. AMENDMENT OF ARTICLE VII, "GENERAL REGULATIONS". <br />Section 2-7.36, "Communication Tower, Communication Antenna, and Wireless Communication <br />Facility Regulations" of Article VII, "General Regulations" of Chapter II, "District and General <br />Regulations" of Part III, Unified Land Development Regulations of the Code of Ordinances of the <br />City of Casselberry, Florida, is hereby amended to read as shown in Exhibit "A" attached hereto. <br />SECTION III. AMENDMENT OF ARTICLE XXI "LANGUAGE AND <br />DEFINITIONS". Section 5-21.2, "Definition of Terms" of Article XXI, "Language and <br />Definitions" of Chapter V, "Glossary" of Part III Unified Land Development Regulations of the <br />Code of Ordinances of the City of Casselberry, Florida, is hereby amended to read as shown in <br />Exhibit "B" attached hereto. <br />SECTION IV. CODIFICATION. It is the intention of the City Commission of the City of <br />Casselberry, Florida, and it is hereby ordained that the provisions of this Ordinance shall become and <br />be made a part of the Code of Ordinances of the City of Casselberry, Florida; that the Sections of <br />this Ordinance may be renumbered or re -lettered to accomplish such intention; that the word, <br />"Ordinance" may be changed to "Section," "Article," or other appropriate word. <br />
