ORDINANCE 20-1543 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO ADOPT THE FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM 2021-2025 AS PART OF THE CITY'S COMPREHENSIVE PLAN IN ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City of Casselberry has a five year Capital Improvement Program that is updated annually and is also known as the Capital Improvement Plan and the Capital Improvement Schedule of the City of Casselberry; and WHEREAS, the Florida Legislature intends that local planning be a continuous and on- going process; and WHEREAS, growth management legislation, F.S. 163.3177(3), requires an annual update to the Five -Year Capital Improvement Schedule (CIS) in the Capital Improvements Element (CIE). NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission does hereby adopt the Five -Year Capital Improvement Program 2021-2025, attached hereto as Attachment "A", into the City of Casselberry's Comprehensive Plan and incorporated by reference. SECTION II. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed to the extent of the conflict. SECTION III. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION IV. EFFECTIVE DATE. This Ordinance shall become effective ten (10) days after its passage and adoption. FIRST READING this day of 004V .- r , A.D. 2020.
