EMERGENCY ORDINANCE 20-1538 <br />AN EMERGENCY ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE ADOPTION OF LEGISLATIVE <br />FINDINGS; AMENDING SECTION 86-72, "SCHEDULE OF RATES AND <br />CHARGES" OF ARTICLE II, "SEWERS", DIVISION 3, "APPLICATION <br />FOR SERVICES; RATES AND CHARGES"; AND AMENDING SECTION <br />86-189, "SCHEDULE OF RATES AND CHARGES" OF ARTICLE III, <br />"WATER", DIVISION 2, "RATES AND CHARGES" TO DELAY RATE <br />INCREASES FOR FISCAL YEAR 2020-2021; PROVIDING FOR <br />SEVERABILITY, CONFLICTS, CODIFICATION AND AN EFFECTIVE <br />DATE. <br />WHEREAS, this Ordinance is enacted as an emergency ordinance under the provisions <br />of Section 166.041(3)(b), Florida Statutes, and Section 2-51 of the Code, and has been enacted <br />by a two-thirds vote of the City Commission; and <br />WHEREAS, this Ordinance pertains to the regulation of utility rates, and is not a land <br />use ordinance or a land development regulation; and <br />WHEREAS, due to the Covid-19 national emergency as recognized by the City in its <br />declaration of emergency and by the Governor in Executive Order 20-52, and the severe <br />hardship that has caused so many of the City's utility customers, the City Commission desires to <br />delay for six months the utility rate increases set to go into effect October 1, 2020; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and strike thfough type shall constitute deletions to the original text, and asterisks (* * *) <br />indicate that text shall remain unchanged from the language existing prior to adoption of this <br />Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. Legislative Findings. The above recitals are hereby adopted as the <br />legislative findings of the City Commission. The City Commission finds and determines that <br />there is competent substantial evidence to support the findings and determinations made in this <br />Section. <br />SECTION II.. Section 86-72, Schedule of Rates and Charges, of Article II, Sewers, <br />Division 3, Application for Service; Rates and Charges, of the Code of Ordinances of the City of <br />Casselberry, Florida, is hereby amended to read as follows: <br />Sec. 86-72. - Schedule of rates and charges. <br />The rates and charges to all regular customers for sewer service shall be based on the following <br />schedule: <br />Ordinance 20-1538 <br />Pagel of 22 <br />
