RESOLUTION 20-3186 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE CONVEYANCE OF AN EASEMENT TO DUKE ENERGY FLORIDA, LLC AT ROTARY PARK, 102 SOUTH WINTER PARK DRIVE, PARCEL ID 09-21-30-5BO-OU01-0000; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry has identified the need for traffic signal improvements at South Winter Park Drive and Queens Mirror Circle; and WHEREAS, the City is nearing completion of design of the South Winter Park Drive at Queens Mirror Circle Traffic Signal Improvements project; and WHEREAS, to accommodate the project, Duke Energy Florida, LLC (Duke) will need to make utility adjustments; and WHEREAS, an easement from the City of Casselberry to Duke to accommodate the required utility adjustments is needed; and WHEREAS, Attachment A is the needed easement, which affects Rotary Park, located at 102 South Winter Park Drive; and WHEREAS, City staff has reviewed the easement and finds it acceptable to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the conveyance of an easement to Duke Energy Florida, LLC for Rotary Park, 102 South Winter Park Drive, parcel ID 09-21-30-5BO-OU01-0000, as provided in Attachment A, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
