RESOLUTION 20-3182 <br />A RESOLUTION OF THE CITY COMMISSION OF <br />CASSELBERRY, FLORIDA, RELATING TO THE <br />DELIVERY AND FUNDING OF STREET LIGHTING <br />SERVICES WITHIN THE CITY; AMENDING, RATIFYING <br />AND CONFIRMING THE PRELIMINARY RATE <br />RESOLUTION FOR FISCAL YEAR 2020-21 AND ALL <br />PREVIOUSLY IMPOSED STREET LIGHTING <br />ASSESSMENTS, CHARGES AND FEES; DETERMINING <br />THAT CERTAIN REAL PROPERTY IS SPECIALLY <br />BENEFITED BY STREET LIGHTING SERVICES; <br />APPROVING THE ASSESSMENT ROLL; PROVIDING THE <br />METHOD OF COLLECTION; AND PROVIDING AN <br />EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Casselberry (the "City") has <br />enacted Ordinance 09-1301 (the "Ordinance"), which authorizes the imposition of Street <br />Lighting Assessments to fund the provision of Capital Projects and street lighting <br />services, facilities and programs which benefit property within the Street Lighting <br />Service Area; and <br />WHEREAS, the reimposition of a Street Lighting Assessment for street lighting <br />services, facilities and programs each fiscal year is an equitable and efficient method of <br />allocating and apportioning Street Lighting Assessed Costs among Tax Parcels within <br />the Street Lighting Service Area; and <br />WHEREAS, on January 27, 2014, the City Commission approved Resolution 14- <br />2571 to engage the services of special counsel Bryant Miller Olive to update the street <br />light assessment methodology; and <br />WHEREAS, on February 24, 2014, a public hearing was held and the City <br />Commission adopted Resolution 14-2572 providing for the Notice of Intent to use the <br />uniform method of collecting a non -ad valorem assessment for funding street lighting <br />services; and <br />WHEREAS, the Preliminary Rate Resolution contains a brief and general <br />description of the street lighting services, facilities and programs to be provided to Tax <br />Parcels within the Street Lighting Service Area; describes the method of apportioning <br />the Street Lighting Assessed Cost to compute the Street Lighting Assessment for street <br />lighting services, facilities, and programs against Assessed Property; estimated rates of <br />assessment and directs the updating and preparation of the Assessment Roll and <br />provision of the notice required by the Ordinance; and <br />
