RESOLUTION 20-3188 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING A LAND LEASE AGREEMENT AND MEMORANDUM OF LAND LEASE AGREEMENT WITH CELLCO PARTNERSHIP D/B/A VERIZON WIRELESS FOR A CELLULAR TOWER AT THE HUNTERFIELD WATER TOWER PROPERTY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry owns the Hunterfield Water Tower property located at 2225 Hunterfield Road, Maitland, FL 32751; and WHEREAS, the City is working to remove the water tower and other on-site infrastructure that is currently out of service and in disarray; and WHEREAS, Verizon Wireless currently has an agreement with the City to have cellular equipment on the water tower that does not expire until 2026; and WHEREAS, in order to demolish the water tower a new lease agreement with Verizon Wireless needs to be executed; and WHEREAS, the new lease agreement will allow for Verizon Wireless to install, maintain, and operate a monopole on the City's property in order to continue to transmit cellular frequencies to the surrounding neighborhood once the water tower has been removed; and WHEREAS, the initial term of the agreement shall be for 5 years beginning on the effective date that the agreement has been executed by both the City and Verizon Wireless; and WHEREAS, a related Memorandum of Land Lease Agreement, which is an abridged version of the Lease, is also provided for recording in the public records to provide notice to third parties that the property is leased; and WHEREAS, City staff has reviewed the Land Lease Agreement and related Memorandum of Land Lease Agreement and finds them favorable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Land Lease Agreement and the Memorandum of Land Lease Agreement with Cellco Partnership d/b/a Verizon Wireless for a cellular tower at the Hunterfield Water Tower Property, attached herewith, and authorizes the Mayor to execute said documents on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
