RESOLUTION 20-3188 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING A LAND LEASE <br />AGREEMENT AND MEMORANDUM OF LAND LEASE AGREEMENT <br />WITH CELLCO PARTNERSHIP D/B/A VERIZON WIRELESS FOR A <br />CELLULAR TOWER AT THE HUNTERFIELD WATER TOWER <br />PROPERTY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry owns the Hunterfield Water Tower property located <br />at 2225 Hunterfield Road, Maitland, FL 32751; and <br />WHEREAS, the City is working to remove the water tower and other on-site <br />infrastructure that is currently out of service and in disarray; and <br />WHEREAS, Verizon Wireless currently has an agreement with the City to have cellular <br />equipment on the water tower that does not expire until 2026; and <br />WHEREAS, in order to demolish the water tower a new lease agreement with Verizon <br />Wireless needs to be executed; and <br />WHEREAS, the new lease agreement will allow for Verizon Wireless to install, maintain, <br />and operate a monopole on the City's property in order to continue to transmit cellular frequencies <br />to the surrounding neighborhood once the water tower has been removed; and <br />WHEREAS, the initial term of the agreement shall be for 5 years beginning on the effective <br />date that the agreement has been executed by both the City and Verizon Wireless; and <br />WHEREAS, a related Memorandum of Land Lease Agreement, which is an abridged <br />version of the Lease, is also provided for recording in the public records to provide notice to third <br />parties that the property is leased; and <br />WHEREAS, City staff has reviewed the Land Lease Agreement and related Memorandum <br />of Land Lease Agreement and finds them favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Land <br />Lease Agreement and the Memorandum of Land Lease Agreement with Cellco Partnership d/b/a <br />Verizon Wireless for a cellular tower at the Hunterfield Water Tower Property, attached herewith, <br />and authorizes the Mayor to execute said documents on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />
